• to engage in spamming, "chain letters," "pyramid schemes", advertisement of illegal or controlled substances, products or services, or other advertising or marketing activities that violate these Terms of Service, any applicable laws, regulations or generally-accepted advertising industry guidelines;


• in a manner that is misleading, deceptive or fraudulent or otherwise illegal or promotes illegal activities, including engaging in phishing or otherwise obtaining financial or other personal information in a misleading manner or for fraudulent or misleading purposes;


• in a manner that is libelous or defamatory, or in a way that is otherwise threatening, abusive, violent, harassing, malicious or harmful to any person or entity, or invasive of another's privacy;


• in a manner that is harmful to minors in any way;


• in a manner that is hateful or discriminatory based on race, color, sex, religion, nationality, ethnic or national origin, marital status, disability, sexual orientation or age or is otherwise objectionable;


• to impersonate any other person, or falsely state or otherwise misrepresent your affiliation with any person or entity, or to obtain access to this Realated website and content without authorization;


• to interfere or attempt to interfere with the proper working of this Realated website and content or prevent others from using this Realated website and content, or in a manner that disrupts the normal flow of dialogue with an excessive number of messages (flooding attack) to this Realated website, or that otherwise negatively affects other persons' ability to use this Realated website and content;


• to use any manual or automated means, including agents, robots, scripts, or spiders, to access or manage any user's account or to monitor or copy this Realated website or the content contained therein;

• Request, solicit or otherwise obtain access to usernames, passwords or other authentication credentials from any contact of this Realated website or to proxy authentication credentials for any contact of this Realated website for the purposes of automating logins to this Realated website;


• Post any content containing child pornography to this Realated website;


• Post any content that depicts or contains rape, extreme violence, murder, bestiality, incest, or other similar or indecent content;


• Post any content that constitutes pornography, contains nudity, or is adult in nature.


• Use automated means, including spiders, robots, crawlers, data mining tools, or the like to download data from this Realated website - except for Internet search engines (e.g. Google) and non-commercial public archives (e.g. archive.org) that comply with our robots.txt file, or "well-behaved" web services/RSS/Atom clients. We reserve the right to define what we mean by "well-behaved";


• Post irrelevant content, repeatedly post the same or similar content or otherwise impose an unreasonable or disproportionately large load on the Realated infrastructure;

• Take any action that may undermine the feedback or ratings systems (such as displaying, importing or exporting feedback information off of this Realated website or for using it for purposes unrelated to this Realated); and


• Develop, invoke, or utilize any code to disrupt, diminish the quality of, interfere with the performance of, or impair the functionality of this Realated website.

You agree not to authorize or encourage any third party to use this Realated website or it’s content to facilitate any of the foregoing prohibited conduct. You also agree that these Realated Terms of Service inure to the benefit of our service providers (including our Realated platform provider) and that they may take action (including the removal of your content and disabling of your account) in order to maintain compliance with these Realated Terms of Service. Technology and hosting for aspects of this Realated website and content are provided by this Realated's online service provider. However, the Realated Creator of this Realated controls the content, membership and policy of this Realated website, including those pages served by such service provider on behalf of this Realated. Notwithstanding anything to the contrary, by participating on this Realated website you agree to indemnify and hold harmless such service provider on all matters related to your interaction with others using this Realated website and participation with Realated, its affiliates and subsidiaries.

Revocation of membership

Realated reserves the right to revoke, terminate, delete and/or freeze you account at any time for violation of these terms. If a member is found to be in violation of the term of service and that violation is a breach of Federal, State and/or intentional law Realated reserves the right to turn over your account to proper law enforcement authorities. Any persons engaging illegal activity and are using Realated to aid in directly or as a convince to said activity void all expectation of privacy.

IMPORTANT-READ CAREFULLY:

This End-User Software License Agreement ("SLA") is a legal agreement between the licensee shown when verifying membership ("YOU") and Realated.com TM, for the computer software and associated media and printed materials (including "online" or electronic documentation) identified as REALATED (“SOCIAL ENGINE”,”ONLINE PLATFORM”,"SOFTWARE PRODUCT" or "SOFTWARE").

By verifying membership, creating a profile, viewing, or otherwise using REALATED’S PRODUCT, YOU agree to be bound by the terms of this SLA. If YOU do not agree to the terms of this SLA, then do not verify you membership, do not use Realated.

DESCRIPTION OF OTHER RIGHTS AND LIMITATIONS

Limitations on Reverse Engineering, Decompilation, and Disassembly - You may not reverse engineer, decompile, or disassemble Realated, except and only to the extent that such activity is expressly permitted by applicable law not withstanding this limitation. Separation of Components - The membership is licensed as a single member. Its component parts may not be separated for use on more than member account.

Rental - Except to the extent permitted in the next following paragraph, you may not loan, sell, rent, license, sub-license or lease the membership account.

Termination - Without prejudice to any other rights, REALATED, may immediately terminate membership without cause. If YOUR SLA is terminated, by either REALATED or YOU, REALATED is not obligated to return or refund any consideration paid pursuant to this SLA.

DATA ENTRY/IMPORT - BEFORE IMPORTING ANY DATA INTO REALATED PRODUCT, REVIEW YOUR LICENSING AGREEMENT WITH THE PROVIDER OF THE DATA TO ENSURE THAT YOU ARE ALLOWED TO DO SO; FOR EXAMPLE, THE COSTAR COMPS' LICENSING AGREEMENT MAY RESTRICT YOU FROM IMPORTING OR HAND ENTERING THEIR SALES COMPARABLE DATA INTO REALATED. REALATED WILL NOT BE HELD RESPONSIBLE FOR ANY BREACH BY LICENSEE OF LICENSEE'S LICENSING OBLIGATIONS DUE TO THE IMPORT OF DATA INTO REALATED. ADDITIONALLY, YOU MAY NOT IMPORT UNIT-LEVEL OR RESIDENT LEDGER DATA FROM ANY MULTIFAMILY PROPERTY MANAGEMENT SYSTEM. YOU AGREE TO ACCEPT ALL RESPONSIBILITY RELATED TO THE DATA YOU ENTER INTO OR IMPORT INTO REALATED AND YOU HEREBY AGREE TO INDEMNIFY AND HOLD HARMLESS REALATED IN THE EVENT THAT YOU ARE NOT PROPERLY LICENSED TO USE THIS DATA IN CONJUNCTION WITH THE SOFTWARE PRODUCT.

COPYRIGHT

All title and copyrights in and to REALATED (including but not limited to any images, photographs, animations, video, audio, music, text, and "applets," incorporated into REALATED), the accompanying printed materials, and are owned by REALATED or its suppliers. YOU hereby acknowledge that the REALATED is protected by copyright laws and international treaty provisions. Therefore, YOU must treat REALATED like any other copyrighted material. You may not copy the printed materials accompanying the SOFTWARE PRODUCT.

U.S. GOVERNMENT RESTRICTED RIGHTS

The SOFTWARE PRODUCT and documentation are provided with RESTRICTED RIGHTS. Use, duplication, or disclosure by the Government is subject to restrictions as set forth in subparagraph (c)(1)(ii) of the Rights in Technical Data and Computer Software clause at DFARS 252.227-7013 or subparagraphs (c)(1) and (2) of the Commercial Computer Software-Restricted Rights at 48 CFR 52.227-19, as applicable. MISCELLANEOUS

If YOU use this service in the United States, this SLA is governed by the laws of the State of California. If YOU use this service in Canada, this SLA is governed by the laws of the Province of Ontario, Canada. Each of the parties hereto irrevocably attorns to the jurisdiction of the courts of the Province of Ontario and further agrees to commence any litigation which may arise hereunder in the courts located in the Judicial District of York, Province of Ontario. If this service is used outside the United States, then local law may apply.

NO WARRANTY

To the extent allowed by applicable law, REALATED does not warrant or guarantee Realated, including any implied warranty.

NO OTHER WARRANTIES

To the maximum extent permitted by applicable law, REALATED and its suppliers disclaim all other warrantees, either express or implied, including, but not limited to, implied warrantees of merchantability and fitness for a particular purpose, with regard to the software product, and any accompanying hardware. This limited warranty gives YOU specific legal rights. You may have others under the laws of the State of California which governs the rights and obligations of the parties to this SLA.

NO LIABILITY FOR CONSEQUENTIAL DAMAGES

To the maximum extent permitted by applicable law, in no event shall REALATED or its partners be liable for any special, incidental, indirect, or consequential damages whatsoever (including, without limitation, damages for loss of business profits, business interruption, loss of business information, or any other pecuniary loss) arising out of the use of or inability to use REALATED, even if REALATED.com has been advised of the possibility of such damages. The exclusion or limitation of liability for consequential or incidental damages shall be governed by the law of the State of California.
